Panache Salon and Spa Terms and Conditions

These Terms and Conditions ("Terms") apply to your use of www.panacheerie.com (the "Site") and to the appointments, services, products, gift cards, and promotions offered by Panache Erie LLC, doing business as Panache Salon and Spa ("Panache," "we," "us," or "our"), 2501 West 12th Street, Erie, Pennsylvania 16505. By using the Site, booking an appointment, or buying from us, you agree to these Terms. If you do not agree, please do not use the Site.

1. Appointments and Online Booking

You can book by phone, by text, in the salon, or online through our booking system. A credit card is required to reserve any appointment. Some services, such as hair extensions, must be paid in advance. Cancellations, rescheduling, late arrivals, and no-shows are governed by our Cancellation Policy, which is part of these Terms. In short, we ask for 48 hours' notice, and changes made with less notice, or missed appointments, are charged 50% of the scheduled service.

2. Your Services

• Consultations and results: every client's hair, skin, and nails are different. We will talk with you about what to expect, but results can vary and are not guaranteed.
• Health and safety: please tell us before your service about allergies, sensitivities, medications, pregnancy, recent treatments, or skin or scalp conditions. We may recommend a patch test, adjust a service, or decline a service if we believe it could be unsafe for you.
• Your satisfaction: if you are not happy with a service, please call us so we can make it right. See our Refunds & Shipping Policies.
• Respect for everyone: we may refuse or end a service if a guest's conduct is unsafe or disrespectful toward our team or other guests.

3. Prices and Payment

Prices on the Site and in the salon may change without notice and may vary by service provider level. The price for your service is confirmed at your visit. Card payments are processed securely by our payment processor; we do not store full card numbers on our own systems.

4. Gift Cards

• Panache gift cards never expire and have no fees of any kind.
• Gift cards can be used for services and retail products at Panache. They cannot be redeemed for cash, except where required by law, and they are not refundable once purchased.
• Please treat gift cards like cash. We are not responsible for lost or stolen cards, but if you have your receipt or card number, we will do our best to help.

5. Plus Cards (Promotional Cards)

• Plus Cards are free promotional reward cards. Panache gives them as a bonus with qualifying gift card purchases (for example, during Customer Appreciation Day) or as a giveaway. Plus Cards are never sold.
• Plus Cards expire 90 days after they are issued. The expiration date is printed on each card.
• Plus Cards have no cash value, cannot be exchanged for cash, are not replaced if lost, and are void after their expiration date.
• A Plus Card is separate from the gift card you purchased. The expiration of a Plus Card never affects your purchased gift card, which never expires.

6. Products, Returns, and Shipping

Product returns, exchanges, and online order shipping are covered by our Refunds & Shipping Policies.

7. Text Messaging (SMS) Terms

Program description: By opting in to text messages from Panache Salon and Spa (for example, by checking the text-message box on our website contact form, by texting us first, or by agreeing at the salon), you agree to receive text messages at the mobile number you provided. These include appointment confirmations and reminders, replies to your questions and one-on-one conversations with our team, and recurring automated promotional and marketing messages such as offers, events, and salon news.

Opt-out: You can cancel the SMS service at any time. Just reply STOP. After you reply STOP, we will send one message confirming that you have been unsubscribed and will send no further texts unless you opt in again. To opt out of promotional texts only while still receiving appointment reminders, let us know by phone, text, or email.

Cost and frequency: Message and data rates may apply. Message frequency varies.

Consent: Consent to receive text messages is not a condition of any purchase or service.

Carriers: Mobile carriers are not liable for delayed or undelivered messages.

Privacy: Your mobile information will not be shared with third parties for marketing or promotional purposes. See our Privacy Policy for details.

8. Email

If you join our mailing list, you agree to receive marketing emails from us. You can unsubscribe at any time using the link in any email.

9. Photos, Video, and Social Media

• Featuring you: we ask your permission before we photograph or film you for our website or social media, including before-and-after photos.
• In the salon: we sometimes take photos or video of our team and salon. Guests may appear in the background. We try to keep guests out of frame or not identifiable, and if you see yourself in any of our posts and want it removed, contact us and we will take it down.
• Your posts: if you tag Panache or share photos of your Panache service with us, you allow us to reshare that content on our channels with credit to you. Please ask permission before photographing other guests.
• No AI changes to results: we never use AI to alter photos of our clients' hair, nails, skin, or other results.

10. Reviews and Content You Send Us

When you send us reviews, comments, or other content, you confirm it is your own and truthful. You allow us to display it, with your first name and last initial, on the Site and in our marketing. We do not pay for or edit reviews to change their meaning, and we may decline to post content that is offensive, unlawful, or unrelated to Panache.

11. Website Content and AI

Information on the Site, including services, prices, and hours, is provided for general information and may change. Some illustrations or promotional imagery may be created or enhanced with digital tools, including AI. That imagery is decorative and never shows real client results. 12. Accessibility

We want everyone to be able to use our Site and enjoy our salon and spa. If you have trouble using any part of the Site or need an accommodation for your visit, please call (814) 838-3333 or email panache@panacheerie.com and we will help.

13. Using the Site

We grant you a limited, non-exclusive, non-transferable license to use the Site for personal, non-commercial purposes. You agree not to misuse the Site, including by attempting to gain unauthorized access, interfering with its operation, using automated tools to copy or scrape its content, or using it for any unlawful purpose. We may suspend or end access to the Site at any time.

14. Intellectual Property

The Site and its content, including text, photos, video, logos, and design, are owned by or licensed to Panache Erie LLC and are protected by copyright, trademark, and other laws. You may not copy or reuse them without our written permission.

15. Third-Party Services and Links

The Site links to services operated by others, such as our online booking, gift card store, and social media pages. Their own terms and privacy policies apply, and we are not responsible for their content or practices.

16. Disclaimers

The Site is provided "as is" and "as available." To the fullest extent permitted by law, we make no warranties, express or implied, about the Site, including that it will be uninterrupted, error-free, or free of viruses or other harmful components.

17. Limitation of Liability

To the fullest extent permitted by law, Panache Erie LLC and its owners, employees, and agents will not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Site. Nothing in these Terms limits any liability that cannot be limited under Pennsylvania law.

18. Indemnification

You agree to defend, indemnify, and hold harmless Panache Erie LLC and its owners, employees, and agents from claims, losses, and expenses, including reasonable attorney's fees, arising from your misuse of the Site or your violation of these Terms or anyone else's rights.

19. Governing Law

These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to conflict-of-law principles. Any dispute will be handled in the state or federal courts serving Erie County, Pennsylvania.

20. Changes to These Terms

We may update these Terms from time to time. Changes take effect when posted on this page with a new "Last updated" date. Continuing to use the Site or our services after changes are posted means you accept the updated Terms.
